TERMS & CONDITIONS

Background

These Terms & Conditions set out the terms under which We will provide one-off hypopressives sessions to You. Please read these Terms & Conditions carefully and ensure that You understand them before booking a session. If You do not agree to be bound by these Terms & Conditions, You will not be able to book a session with Us.

Hypopressives is a form of physical exercise involving postural holds and specific breathing techniques. Participation in hypopressives sessions carries inherent physical risks. Please ensure You have read and understood the health, safety and medical disclaimer provisions set out in Clause 5 below before booking a session.

1.         Definitions

In these Terms & Conditions, unless the context otherwise requires:

"Contraindications" means those health conditions and circumstances which may make it inadvisable for You to participate in hypopressives exercises, or in the apnea (breath hold) element of those exercises, as set out in Clause 5.3;

"Data Protection Legislation" means all applicable data protection and privacy legislation in force from time to time in the UK including the UK GDPR; the Data Protection Act 2018 (and regulations made thereunder); the Privacy and Electronic Communications Regulations 2003 as amended; the Data (Use and Access) Act 2025 and all other legislation and regulatory requirements in force from time to time relating to the use of personal data;

"Fee" means the fee payable for the Session as set out on Our Site or as otherwise advised to You;

"Instructor" means Lucy Warwick, trading as Bristol Hypopressives or any suitably qualified instructor engaged by Us to deliver the Session to You;

"Our Site" means Our website at www.bristolhypopressives.com ;

"Session" means a single hypopressives session (whether 1-to-1 or a group class) booked by You with Us, whether delivered in person or online;

"Us / We / Our" means Bristol Hypopressives of 37 South Court Avenue, Dorchester, DT1 2BY and

"You / Your" means the person booking and attending a Session with Us.

2.         Booking and Payment

2.1       Your request to book a Session is an offer, which We may accept or decline at Our discretion. Only once We have accepted Your booking will there be a binding agreement between Us for that Session.

2.2       The Fee shall be payable by You in advance of the Session, via the payment method specified on Our Site or as otherwise advised to You.

2.3  Times and dates for Sessions are subject to availability and offered on a first-come-first-served basis.

2.4       Sessions will take place either online (via Zoom or similar platform) or in person at the address specified on Our Site at the time of booking.

3.         Cancellation and Rescheduling

3.1       If You are unable to attend a scheduled Session, You must advise Us not less than [48] hours before that Session.

3.2       Provided You give the notice specified in Clause 3.1, You may reschedule the Session to a mutually agreed date, or receive a refund of the Fee paid, at Our discretion.

3.3       If You do not give the notice specified in Clause 3.1, the Session will be forfeited and You shall not be entitled to reschedule it or to any refund.

3.4       If You arrive late for a Session, the time for the Session will be reduced accordingly. There will be no corresponding reduction in the Fee.

3.5       We reserve the right to cancel or reschedule a Session due to Instructor unavailability, technical issues, or other circumstances beyond Our control. In such cases, We will offer You an alternative date or a full refund of the Fee paid.

4.         Your Obligations

4.1       You undertake to:

            4.1.1    complete any pre-screening or registration form fully and accurately;

4.1.2    provide promptly any information requested from You, including information relating to Your health and any current conditions;

4.1.3    conduct Yourself in a responsible and courteous manner at all times;

4.1.4    attend Sessions on time; and

4.1.5    comply with all reasonable instructions given by the Instructor during Sessions.

4.2       You undertake not to record any Session, by any means, without Our advance permission.

4.3       We reserve the right to refuse entry to a Session, or to ask You to leave a Session, if You are in breach of these Terms & Conditions or if Your behaviour is disruptive or inappropriate. No refund shall be due in such circumstances.

5.         Health, Safety, Contraindications and Medical Disclaimer

5.1       You acknowledge that engaging in physical activity, including hypopressives exercises, carries inherent risks of injury. You undertake to be responsible for Your own safety and wellbeing while participating in any Session. Your participation is entirely voluntary, and You assume all risks of injury to Yourself arising from Your participation.

5.2       You must ensure that You are fit and well enough to participate in any Session that You book. We strongly recommend that You consult Your doctor or healthcare provider before attending Sessions, particularly if You have any pre-existing health conditions or concerns. If You have any of the Contraindications listed in Clause 5.3, or any other health condition, You must disclose this to Us and obtain medical clearance before participating.

5.3       Hypopressives exercises, and in particular the apnea (breath hold) element, are not suitable for everyone. The following are contraindications to performing the hypopressive apnea (the Contraindications). If any of the following apply to You, You must not perform the apnea element of hypopressives exercises unless You have received express clearance from Your doctor or healthcare provider:

5.3.1    pregnancy (hypopressives apnea is contraindicated throughout pregnancy);

5.3.2    uncontrolled or unstable high blood pressure (hypertension);

5.3.3    cardiovascular disease, heart conditions, or a history of heart problems;

5.3.4    pulmonary disease, severe respiratory disorders, or COPD;

5.3.5    recent abdominal or pelvic surgery (generally within six weeks, or as advised by Your surgeon);

5.3.6    hernia (including hiatal hernia, inguinal hernia, or abdominal hernia);

5.3.7    active cancer or undergoing cancer treatment;

5.3.8    intestinal or stomach inflammation or acute digestive conditions;

5.3.9    an IUD or intrauterine device (You may perform the apnea only under physician supervision);

5.3.10  recent postpartum (generally within six weeks of giving birth, or as advised by Your healthcare provider); or

5.3.11  any other medical condition that may be adversely affected by changes in blood pressure, breath holding, or physical exertion.

5.4       If You have any of the Contraindications listed in Clause 5.3 above, You may still be able to participate in certain elements of a Session (such as the postural and breathing exercises without the apnea), subject to obtaining medical clearance. We will work with You to adapt the Session where possible, but We cannot guarantee that the Session will be suitable for You.

5.5       We and Our Instructor(s) are not medical professionals. We cannot and do not provide medical advice, diagnosis, or clearance. The exercises and information provided during a Session are not a replacement for medical advice. You must not rely on any information provided during a Session as a substitute for professional medical advice, diagnosis, or treatment.

5.6       By booking and attending any Session, You confirm and warrant that:

            5.6.1    You have read, understood, and accept the contents of this Clause 5;

5.6.2    You have consulted with Your doctor or healthcare provider if You have any health conditions or concerns, and have been medically cleared to participate;

5.6.3    You do not have any Contraindications (as set out in Clause 5.3) or health conditions that would prevent You from participating safely, or You have disclosed these to Us and have obtained appropriate medical clearance;

5.6.4    all information You have provided to Us regarding Your health is complete, accurate, and up-to-date; and

5.6.5    You will inform Us immediately if Your health circumstances change before the Session.

5.7       If You experience any faintness, dizziness, pain, shortness of breath, nausea, heart palpitations, or any other concerning symptoms during any Session, You must stop immediately, inform Us, and seek advice from Your healthcare provider before continuing.

5.8       You acknowledge and agree that in-person Sessions may involve a certain amount of physical contact between the Instructor and You to ensure proper technique or to provide support.

5.9       You must not make any changes to, or cease to use, any prescription medication or course of treatment as a result of attending a Session without first consulting Your doctor or healthcare provider.

6.         Our Liability

6.1       We shall provide Sessions with reasonable skill and care, consistent with prevailing standards in the hypopressives and pelvic health industry in the United Kingdom.

6.2       Subject to the remainder of this Clause 6, We will be responsible for any foreseeable loss and damage that You may suffer as a result of Our breach of these Terms & Conditions or Our negligence. Loss or damage is foreseeable if it is an obvious consequence of Our breach or negligence. We will not be responsible for any loss and damage that is not foreseeable.

6.3       Nothing in these Terms & Conditions seeks to exclude or limit Our liability for death or personal injury caused by Our negligence, or for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited by English law.

6.4       Subject to Clause 6.3, You agree that We shall not be responsible for any injuries or health issues that may arise as a result of Your participation in a Session where such injuries or health issues result from:

            6.4.1    Your failure to disclose relevant health information to Us;

6.4.2    Your failure to obtain medical clearance where required;

6.4.3    Your participation in exercises that are contraindicated for You;

6.4.4    Your failure to follow instructions given by the Instructor during the Session;

6.4.5    Your failure to stop exercising when experiencing concerning symptoms; or

            6.4.6    the inherent risks of physical exercise.

6.5       We (and the Instructors engaged by Us) are not acting in the capacity of doctor, physiotherapist, or other licensed or registered medical professional, and any guidance given by Us is not intended to take the place of medical advice. We do not prescribe or provide medical services, or diagnose, treat or cure any disease, condition or other physical or mental ailment.

6.6       Sessions are intended for non-commercial use only. Accordingly, We shall not be liable in respect of any loss of profit, loss of business, interruption to business, loss of business opportunity, or any indirect, special or consequential loss or damages.

6.7       Our total liability to You in respect of any claims arising out of or in connection with a Session, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed the Fee paid by You for that Session.

6.8       For online Sessions, We do not guarantee that those Sessions will be uninterrupted or error-free. We shall not be liable for any technical issues that could disrupt service delivery, such as internet disruptions or software compatibility issues, which are beyond Our control.

6.9       If You bring any personal belongings to an in-person Session, We do not undertake to keep them safe or provide any safe storage place for them. Their loss or damage will be at Your own risk.

7.         Events Outside Our Control

We shall not be liable for any failure or delay in providing a Session where that failure or delay arises from a cause or event that is beyond Our control. Such causes or events may include, but are not limited to: power failure, internet service provider failure, service interruptions, industrial action by third parties, civil unrest, fire, explosion, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action, epidemic, pandemic, or other natural disaster or any other event that is beyond Our reasonable control.

8.         Data Protection

8.1       All personal information that You and We may use shall be collected, processed and held in accordance with the provisions of the Data Protection Legislation.

8.2       For complete details of Our collection, processing, storage, and retention of personal data, please refer to the Privacy Notice which is available on request or on Our Site.

8.3       By booking a Session, You consent to Us holding, processing and accessing Your personal and special category or sensitive personal data (including health and medical information) for all purposes relating to provision of the Session, in accordance with Our Privacy Notice.

8.4       If We notify You in advance that We will be recording a Session, You consent to Us recording, storing and using that recording including Your voice, likeness and image in accordance with the Data Protection Legislation. If You do not wish to be recorded, please inform Us before the Session.

10.      General

10.1  No failure or delay by Us in exercising any of Our rights under these Terms & Conditions shall be deemed to be a waiver of that right.

10.2     You may not transfer Your rights under these Terms & Conditions without Our express written permission.

10.3     These Terms & Conditions are between You and Us. No third party shall have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of these Terms & Conditions.

10.4     If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the remainder shall continue in full force and effect.

10.5     We may revise these Terms & Conditions from time to time. The version in force at the time You book a Session will apply to that Session.

11.      Governing Law and Jurisdiction

11.1     These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales.

11.2     Any dispute, controversy or claim arising out of or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England & Wales, Scotland or Northern Ireland as determined by Your residency.
